Korangteng, the Judicial Secretary, on July 12, 2024, with the title &#8220;Enforcement of articles 117 and 118 of the Constitution &#8211; Immunity from Service of Process and Arrest.&#8221;<\/p>\n\n\n\n<p>&#8220;The Rt. Hon. Speaker has directed the return of the attached processes for your necessary action,&#8221; the letter concluded, suggesting that the Judiciary take note of the constitutional restrictions regarding the service of court documents to Members of Parliament.<\/p>\n\n\n\n<p><strong>Background<\/strong><\/p>\n\n\n\n<p>On October 18, the Supreme Court issued a stay of execution on Speaker Alban Bagbin&#8217;s ruling, which declared four parliamentary seats vacant.<\/p>\n\n\n\n<p>Parliament was, in essence, instructed to recognise and allow the four MPs to fully represent their constituencies and carry out their official duties.<\/p>\n\n\n\n<p>This directive will remain in effect, not for the 10 days initially requested by the applicants, but until the Supreme Court delivers its final ruling on the case.<\/p>\n\n\n\n<p>The application to stay the Speaker&#8217;s decision was filed by NPP MPs who sought the Court&#8217;s intervention to halt the enforcement of the ruling that would have affected three of their colleagues and one from the NDC.<\/p>\n\n\n\n<p>The application was filed ex parte, meaning that neither Speaker Bagbin nor Parliament was joined to the case.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Read also:\u00a0<a href=\"https:\/\/www.myjoyonline.com\/what-ndc-did-was-evil-afenyo-markin-says-over-declaration-of-4-parliamentary-seats-vacant\/\">\u201cWhat NDC did was evil\u201d \u2013 Afenyo-Markin says over declaration of 4 parliamentary seats vacant<\/a><\/li>\n<\/ul>\n\n\n\n<p>This allowed the Court to consider the NPP MPs&#8217;
